Article 1 – Purpose
The terms and conditions described below lay down the rights and obligations of the company DAR and its customers in the framework of products online sale offered by the Seller on the website www.daradam.com
All services performed by the DAR company implies unconditional acceptance by the buyer of these Terms and Conditions of Sale.
Article 2 – General Provisions
These General Terms and Conditions (GTC) apply to all sales of products made through the www.daradam.com website.
DAR Company reserves the right to modify these terms and conditions at any time by publishing a new version on its website. The applicable GTC are those being in force at the date of payment of the order. These Terms are available on the website of the Company at the following address: https://www.daradam.com/en/terms-of-sales. The Company also ensures that their acceptance is clear and unqualified by setting up a checkbox and a validation click. The Customer declares to be aware of all these General Terms and Conditions, and if any of the Special Conditions of Sale relating to a product or service, and to accept without restriction or reservation. The Customer acknowledges that he/she has received the necessary information and advice to ensure the adequacy of the offer to his/her needs. The Customer states to be able to lawfully contract under French laws or validly represent the legal person for which he/she is committed. Unless proved otherwise, the information recorded by the Company constitute proof of all transactions.
Article 3 – Product Prices
Prices of products sold on the website www.daradam.com are in Euros, including tax and but excluding transport charges, on the pages of product descriptions. They are also indicated in euros all taxes included (VAT + other taxes) on the product order page, and including transport charges. For all products shipped outside the European Union and / or overseas territories, the price is calculated including taxes automatically on the invoice. Customs duties or other local taxes or import duties or state taxes may be payable in certain cases. These rights are not within the purview of the Seller. They will be borne by the buyer and shall be his responsibility (statements, payment to the competent authorities, etc.). DAR Company reserves the right to change prices and delivery charges at any time but the products ordered are charged at prevailing prices when the order is recorded.
Article 4 – Order
To place an order, the customer must follow a series of steps described below:
Information about the essential characteristics of the product;
Choice of Product and its options (if any);
Indication of the essential customer data (identification, address …);
Verification of the order elements and, if necessary, correction of errors;
Selection of the delivery mode;
Acceptance of these General Terms and Conditions;
Choice of payment method and payment for the order.
The Customer will receive a confirmation email of the order payment and an acknowledgement of receipt confirming the order, accompanied by a pdf copy of these General Terms and Conditions.
Order delivery will be at the address indicated by the Customer. For the purposes of proper completion of the order, and pursuant to Article 1316-1 of the Civil Code, the Customer undertakes to provide his truthful personal information.
The Seller reserves the right to refuse the order for any legitimate reason.
Article 5 – Availability
Orders will be processed within the limits of our available stocks and subject to availability from our suppliers. When ordering a product which become unavailable, the customer will be informed of this situation as soon as possible by e-mail, and the order of this product may be canceled upon request. The customer can then ask for a credit of the amount of the product usable for a next order or he can ask to be refunded.
Article 6 – Payment
The payment of order is by wire bank transfer, Paypal or credit card.
The secure online payment by Paypal and credit card is carried out by our payment provider. The information transmitted is encrypted in accordance with all the proper rules; the website uses a secure payment SSL (Secure Socket Layer).
– By credit card: Carte Bleue, e-carte bleue, Visa, Mastercard. The transaction is debited immediately after checking the information.

Pursuant to Article L. 132-2 of the Monetary and Financial Code, the commitment to pay given with credit card is irrevocable. By providing bank details during the sale process, the Customer authorizes the Seller to charge his card or Paypal account the amount indicated on the price. The Client confirms that he is the legal owner of the debit card or Paypal account and is legally entitled to use them. In case of error, or failure to debit the card or Paypal account, the sale is immediately canceled and the order is automatically canceled.
Article 7 – Withdrawal period
Pursuant to Article L. 121-20 of the Consumer Code, the buyer has a period of fourteen days, from the receipt of goods, to exercise his right of withdrawal without any reasons or paying penalties, except, where applicable, the cost of return. If the period of fourteen days to expire on a Saturday, Sunday or a holiday, it is extended to the next business day.
In case of exercising the right of withdrawal, the company will reimburse the Buyer all sums paid as soon as possible and at the latest within fourteen days of the date on which this right was exercised and the goods where returned.

Article 8 – Title retention clause
The products remain the property of the Company until full payment.
Article 9 – Late / delayed payment (clause applicable to professionals)
In case of default of total or partial payment of goods delivered on the day of receipt, the buyer shall pay to the company DAR a late penalty equal to one and half times the legal rate of interest.
The selected legal rate of interest is that in force on the day of delivery of the goods.
This penalty is calculated on the amount net of tax of the sum remaining had, and runs as from the expiration date of the price without any prior notice being required.
Any delay in payment, in addition to late payment penalty, automatically results in the charging of the debtor to pay a fixed compensation of 40 € for recovery costs.
Additional compensation can be claimed on evidence when the recovery costs incurred exceed the amount of the fixed compensation.
Article 10 – Delivery
The Products are delivered to the address of delivery indicated when ordering and within the time indicated. This time of delivery does not take into account the preparation time of the order.
In case of delayed delivery, the customer has the option to terminate the contract according to the terms and conditions defined in Article L 138-2 of the Consumer Code. The Seller will then reimburse the product and the “one-way” fees under the terms of Article L 138-3 of the Consumer Code.
The Seller provides a telephone contact point (cost of a local call from a landline) specified in the order confirmation email to follow up the order.
The Seller recalls that when the customer has physical possession of the goods, the risk of loss or damage to the goods is transferred to him. It is the Customer’s responsibility to notify the carrier about any reservations concerning the product delivered.
Article 11 – Guarantees
All products for sale on the Website have the legal guarantee of conformity (Articles L211-1 and following of the Consumer Code) and the guarantee against hidden defects (Article 1641 of the Civil Code), allowing you to return the products delivered if defective or nonconforming.

You have a period of two years from the issuance of the product to act under the legal guarantee of conformity. In that case :

– You can decide to enforce the guarantee against hidden defects of the good sold within the meaning of Article 1641 of the Civil Code. In this case, you can choose between canceling the sale or reduction of the sales price (provisions of Articles 1644 of the Civil Code).
